These Terms govern your access to and use of Searchary. By using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

These Terms & Conditions (“Terms”) govern your access to and use of the Searchary website and related pages (together, the “Site”), operated by Searchary (“we”, “us”, “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Searchary

Searchary is a product discovery website that helps visitors browse, search, and explore product listings across categories. We also offer optional display plans that let sellers pay to list an approved product on the shop grid, as described in section 8.

For products shown in the catalogue, Searchary is generally not the retailer and does not process purchases on your behalf when you click through to a brand’s own site. Display plan fees are paid to Searchary for listing and discovery services, not for buying the listed product itself.

Product listings, prices shown on third-party sites, and community ratings may be incomplete or out of date. Always confirm details with the relevant provider before buying.

2. Eligibility

You must be at least 18 years old, or have permission from a parent or guardian, to use the Site. You are responsible for ensuring that your use of the Site complies with applicable laws in your location.

3. Accounts

Some features require a free account. You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account.

We may suspend, restrict, or terminate your account or access to the Site at any time, with or without notice, if we reasonably believe you have breached these Terms, created risk for us or other users, or for any other legitimate business reason. Upon termination, your right to use the Site ends immediately. Sections that by their nature should survive termination will continue to apply.

4. Acceptable use

You agree not to:

  • Use the Site for any unlawful, harmful, deceptive, or fraudulent purpose;
  • Harass, abuse, defame, or threaten others, or post unlawful, offensive, or misleading content;
  • Attempt to gain unauthorised access to the Site, its servers, accounts, or related systems;
  • Scrape, crawl, harvest, or systematically extract data from the Site by automated or manual means without our prior written consent;
  • Reverse engineer, decompile, or attempt to derive source code from any part of the Site except where permitted by law;
  • Introduce viruses, malware, or other harmful code;
  • Impersonate us or misrepresent your affiliation with Searchary or any third-party brand;
  • Submit false, misleading, or infringing product listings, reviews, or other content;
  • Circumvent security, rate limits, moderation, or access controls;
  • Use the Site in a way that could damage, disable, overburden, or impair its operation or the experience of other users.

We may monitor use of the Site to enforce these Terms, protect users, and maintain security. We may remove content, disable features, or suspend access without prior notice where we reasonably consider it necessary.

5. User content and submissions

The Site may allow you to submit reviews, product listings, images, messages, profile details, and other content (“User Content”). You retain ownership of your User Content, but you grant Searchary a worldwide, non-exclusive, royalty-free, sublicensable licence to use, host, store, reproduce, modify, adapt, publish, display, distribute, and otherwise exploit User Content in connection with operating, promoting, and improving the Site and our services.

You represent and warrant that you have all rights needed to submit User Content and that it does not infringe any third-party rights or violate any law. You agree that we may edit, format, reject, remove, or decline to publish User Content at our sole discretion, including for quality, accuracy, eligibility, legal compliance, or commercial reasons, without liability to you.

You agree to indemnify and hold harmless Searchary against claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your User Content or your breach of these Terms.

6. Product information and accuracy

Product names, descriptions, prices, ratings, and availability shown on the Site may be incomplete, illustrative, or out of date. We do not guarantee that any listing is accurate, available, or offered at the price shown.

Any purchase of goods or services must be made directly with the relevant retailer or seller, not through Searchary, unless we explicitly state otherwise on the Site.

7. Third-party logos, trademarks, and brand assets

The Site may display logos, wordmarks, icons, product images, packaging, trade dress, and other brand assets belonging to third parties. This includes brands shown today (for example app and software brands shown in the catalog) and any other logos or marks we add in future, across any product category we choose to feature.

Ownership. All third-party logos, trademarks, service marks, trade names, and related intellectual property remain the exclusive property of their respective owners. Nothing on the Site grants you any licence or right to use those marks.

No affiliation. Searchary is an independent product discovery website. Unless we clearly and expressly state otherwise on a specific page, we are not affiliated with, endorsed by, sponsored by, or officially connected to any third-party brand, manufacturer, or retailer whose logos or products appear on the Site.

Why we show them. Logos and brand assets are used solely to help visitors identify products, categories, or brands being discussed or discovered—for example in search results, filters, or listings. We do not claim ownership of those assets and do not use them to suggest we are an official brand store or authorised reseller unless we say so in writing.

Your use. You must not copy, download, modify, redistribute, or use any third-party logo or brand asset from the Site for your own commercial purposes, merchandise, social media, or any use that could confuse consumers about the source of goods or services. Any permitted use of a brand’s marks requires permission from that brand’s owner.

Accuracy and availability. Logos and product imagery may be illustrative, outdated, or sourced from publicly available materials. We do not guarantee that every logo reflects a brand’s current official artwork or that every product shown is still sold by that brand.

Changes and removal. We may add, replace, or remove third-party logos and listings at any time without notice, including in response to rights-holder requests, licensing changes, or Site updates.

Copyrighted images. Images may be copyright protected. If your copyrighted image appears on this site and you would like it removed, please contact us at contact@searchary.co.uk.

Rights-holder enquiries. If you are a trademark or brand owner and believe content on the Site misuses your intellectual property, please contact us at contact@searchary.co.uk with details of the mark, the URL or page where it appears, and your relationship to the rights. We will review good-faith requests and respond as we consider appropriate in our discretion, which may include correcting or removing content, requesting additional information, or taking no action.

No warranty regarding third-party IP. We make no representation that our display of any third-party logo or product information is authorised by the rights holder. To the extent permitted by law, we disclaim liability arising from third-party intellectual property claims related to such content, subject to our obligation to address valid takedown or correction requests when brought to our attention.

8. Display plans and seller subscriptions

If you submit a product for listing on Searchary, you may choose a paid display plan so your approved listing can appear on the shop grid. Current plan options and prices are shown on the Submit product page (at the time of writing: £5.99 per month or £79.99 per year, billed in GBP). We may change plan prices for new subscriptions by updating the Site; existing subscriptions are governed by the price shown at checkout unless we notify you otherwise as required by law.

Payment. Display plan fees are collected through Stripe. By subscribing, you authorise recurring charges to your chosen payment method until you cancel renewal. You must provide accurate billing details and keep your payment method valid.

Review before going live. Payment does not guarantee publication. Searchary reviews submissions for accuracy, eligibility, quality, and compliance with these Terms. We may approve, request changes, edit, suspend, or decline a listing at our sole discretion. If we decline or remove a listing after payment, fees are generally non-refundable except where required by applicable law. Contact us at contact@searchary.co.uk if you believe a charge was made in error.

Renewals. Monthly and annual plans renew automatically at the end of each billing period unless you cancel renewal before the next charge date. We may send renewal reminder emails before a charge is due.

Cancellation. You can cancel renewal from Billing & plan in your account. Cancellation stops future renewals; your listing generally remains visible until the end of the current paid period, after which display access may end unless you renew or we agree otherwise in writing.

Refunds. Display plan fees are for access to Searchary’s listing and discovery service for the billing period you have paid for. Except where required by applicable law, fees are non-refundable once a billing period has started, including if you cancel mid-period, if your listing is declined, edited, suspended, or removed, if you stop using the Site, or if your account is terminated for any reason. Nothing in this section limits your statutory rights as a consumer in the UK, including any right to a refund where the service was not supplied as agreed.

Billing disputes. If you believe a charge is incorrect, contact us promptly at contact@searchary.co.uk with your account email and submission details. Chargeback or payment disputes should be raised with us first where possible so we can investigate.

9. Affiliate and commercial links

The Site may include links to third-party retailers or affiliate programmes. If we earn a commission when you click a link and make a purchase, we will disclose that relationship on the relevant pages where required. Third-party websites have their own terms and privacy policies, which apply once you leave the Site.

10. Intellectual property (Searchary content)

The Site’s layout, design, text, and original content created by us (excluding third-party trademarks, logos, and product assets described in section 7) are owned by Searchary or our licensors and are protected by copyright and other intellectual property laws. You may view and print pages for personal, non-commercial use. You may not copy, modify, distribute, or exploit our original Site content for commercial purposes without our written permission.

11. Disclaimer of warranties

The Site and all content, listings, ratings, recommendations, and information on it are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from harmful components, or that any listing, price, review, or third-party link is accurate, complete, or current.

12. Limitation of liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.

Subject to the above, we shall not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profit, revenue, business, data, goodwill, or anticipated savings, arising from or in connection with your use of the Site, User Content, third-party links, or reliance on any content on the Site, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if we have been advised of the possibility of such loss.

Our total aggregate liability to you for any claim arising from or relating to these Terms or your use of the Site shall not exceed the greater of (a) £100 or (b) the total display plan fees you paid to Searchary in the twelve months before the event giving rise to the claim, except where a higher limit is required by law.

13. Indemnity

You agree to indemnify, defend, and hold harmless Searchary and its operators, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your User Content, your breach of these Terms, or your violation of any law or third-party rights.

14. Force majeure

We are not liable for any failure or delay in performing our obligations where caused by events beyond our reasonable control, including internet outages, hosting failures, strikes, natural disasters, war, terrorism, government action, or third-party service failures.

15. Changes to the Site and these Terms

We may update the Site or these Terms at any time. The “Last updated” date at the top will change when we do. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. If you do not agree to updated Terms, you must stop using the Site.

16. General

Entire agreement. These Terms, together with our Privacy Policy and any additional terms referenced on the Site, constitute the entire agreement between you and Searchary regarding the Site.

Assignment. You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

17. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising from these Terms or your use of the Site, except where mandatory consumer protection laws in your country of residence give you the right to bring proceedings elsewhere.
